Ending Enforcement of Defense Law No. 13 of 1992

The suspension of the Defense Law, means canceling all Defense Orders issued pursuant to it, and resuming the application of the provisions of the Jordanian laws in force.
The most significant Defense Orders cancelled pursuant thereto, of which pertain to the Defense Order No. (5) of 2020 related to the Procedures for Organizing General Assembly Meetings, Boards of Directors, and Management Committees for Public Shareholding Companies, Private Shareholding Companies and Limited Liability Companies, suspending the provisions of Companies Law No. (22) of 1997 and its amendments, and the regulations and instructions issued pursuant thereto being cancelled. In this regard, the provisions of the Companies Law and the regulations issued thereunder are now applicable, including the application of the provisions included in the companies’ Memorandum and Articles of Association.
In addition, Defense Order No. (28) pertaining to the suspension of debtor’s imprisonment has been cancelled, meaning that the provisions regarding the imprisonment of debtors are governed now by the applicable Enforcement Law No. (25) for year 2007 and its amendments.
Further, Defense Order No. (6), which restricted the right of employers to terminate indefinite employment contracts based on the provisions of the Labor Law, and oblige employers to renew limited term employment contracts until the end of the Defense Law, has been cancelled, and the provisions of the Labor Law No. (8) of 1996 and its amendments shall now apply.
